The TSSA “3-Year Rule”
Under the latest TSSA Fuel Oil Code Adoption Document (CAD), any fuel oil tank — aboveground or underground — that has been inactive for three years or more is now classified as high-risk non-compliance and must be professionally removed.
Dormant systems no longer qualify for grandfathered status under Ontario regulations.
Insurance & Real Estate Requirements in Toronto
Most insurers now refuse coverage for:
- Exterior tanks over 15 years old
- Interior tanks over 20–25 years old
Toronto mortgage lenders increasingly require an official Certificate of Tank Removal before approving property transfers or refinances.
Without documentation, home sales can stall — or collapse entirely.
Escalating Environmental & Soil Disposal Costs
A single oil leak can contaminate soil and groundwater beneath your home. In 2025:
- Ontario Excess Soil Registry fees increased by 30%
- Legal disposal of contaminated soil has become extremely costly
- Environmental cleanup costs in Toronto regularly exceed $100,000
Early removal dramatically reduces risk and long-term liability.
